EclipseIt's the end of justice, is the end of the press, it is the end of blogs in Italy. Berlusconi's government decree on wiretapping is a decisive move to sweep away press freedom and security of the country. The judiciary is no longer authorized to tap phones on the basis of suspicion, but only if there is "clear evidence of guilt" and for a maximum of 60 days, and anyway newspapers cannot publish them until after the end of the process, i.e. after years. As for the blogs they will be required to rectify any news or any comment upon request, on the penalty of a fine from 7500 to 12,500 euros . A figure more than enough to cut the legs to any private citizen. Criminals now may act unpunished.
How you can in fact discover rapers, thieves, murderers, polluters, corrupters and so on without tapping their phones? The wiretapping was often essential to acquire  clear evidence of guilt, not just to confirm them. Mobsters and terrorists may still be wiretapped, but only if the judiciary has suspicions about them. They cannot anymore find them investigating other crimes, such as environmental pollution, usury, theft and receiving stolen goods, as often happens. Politicians, criminals and swindlers of all kinds will be able to talk on the phone of anything they want without fear of being tapped by the judiciary and published in newspapers. Whatever they do they will not have to answer for. And if a few would dare publish a blog article on them, they can immediately rectify it.
And all that came from famous cases when italian politicians, of left and right, were caught on phone speaking of embarassing subjects like girls, friends to help somehow and so on. Now they have no scruples to destroy justice and press freedom to save themselves from the truth.
The truth, that already became an opinion in Berlusconi dominated Italy, now stops to exist. The crimes unpunished will grow exponentially throughout Italy with this law, but no one will know. The information is already almost completely in the hands of Berlusconi and has completely ignored the attack on democracy that this decree entails. Darkness will fall on this country but no one will know. It's a party for pedophiles, murderers, thieves, corrupted, the cheaters, rapists, illegal moneylenders, polluters and all other kinds of criminals. They also cut funds to the police, so Italian citizens will suffer the crimes but no one will mention it, since the media payed or controlled by Berlusconi will only give the news that put the government in good light and make the Italians believe that all is well.
It's the night of democracy in Italy, and too many are asleep.

Umm, the end of wiretapping is an expansion of freedom, not taking awayfrom it

Yes, and the end of police, justice and the state would be the maximum of freedom. I could like that, but it's just that I don't think that Berlusconi did it out of love for freedom. He did it because he was often caught on tape speaking of mafia, girls, corruption and so on. Wiretapping was sometimes essential to judges and police to find proof of heinous crimes. Now it's simply impossible to do it. I could be wiretapped anytime, because I don't plan crimes on the phone (or anywhere else :-) Then why italian politicians feared wiretapping? It's an easy answer.

France has exactly the same limitations of the power of the police through the authorization of a judge for wiretapping, since years !

It's not the same thing at all. First, the law is clearly done to protect politicians from scandals, not common citizens from abuse. Second, the authorization of a judge was necessary in Italy too, but now the request can be authorized only if there are clear evidences of guilty, only if it's absolute essential and by a panel of three judges, if the prosecutor can find them in time, and anyway only for 60 days. It's a law that make wiretapping virtually impossible and useless and destroy completely an important weapon of the judiciary, In fact all italian judges are against it.

There is a fine balance that needs to be kept and it is difficult to know where government spying on citizens should stop.

Usually the authority, regimes who uses such methods to control people and to get more power end similarly. They disappear or substituted very soon. As for me I'm very interesting in History. For those who is fond of History, too I advice the book search engine http://pdf.rapid4me.com . Well, there were a lot of similar stories in our history. It is a pity that people in power haven't learn it and do not know the power and strenght of the whole nation.
